1. Acceptance of Terms
By creating an account or using Farm Stand Exchange (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By agreeing to these terms you represent that you meet this requirement.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@farmstandexchange.com if you suspect unauthorized access.
4. Acceptable Use
You agree not to misuse the Service. Prohibited activities include, but are not limited to: uploading harmful or illegal content, attempting to gain unauthorized access to our systems, using automated tools to scrape data, and any activity that violates applicable law.
5. Intellectual Property
Farm Stand Exchange and its underlying technology are owned by us and protected by intellectual property law. You retain ownership of content you post, but grant us a limited license to display and distribute it as part of operating the Service.
6. Termination
We reserve the right to suspend or terminate your account for violation of these terms or for any other reason at our sole discretion. You may delete your account at any time through the app settings.
7. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation.
8. Limitation of Liability
To the fullest extent permitted by law, Farm Stand Exchange shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
9. Indemnification; Assumption of Risk; User Responsibility
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Farm Stand Exchange, its owners, officers, directors, employees, contractors, affiliates, successors, and assigns from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or related to:
(a) your use of the platform or services;
(b) your creation, publication, or maintenance of any farmstand listing, including but not limited to the disclosure of your address or location information;
(c) any interactions, transactions, or communications between you and third parties arising from your listing;
(d) any condition, operation, or management of your farmstand or property; and
(e) any actual or alleged personal injury, property damage, theft, vandalism, trespass, or other harm occurring at or related to your property or farmstand.
You acknowledge and agree that listing a farmstand, including providing a physical address or location, may increase public visibility and may carry inherent risks, including but not limited to unwanted visitors, trespass, theft, vandalism, or other security-related incidents. You expressly assume all such risks.
You further agree that Farm Stand Exchange does not verify users, listings, or locations, and does not provide security, monitoring, or protection services of any kind. You are solely responsible for determining whether to list your property, what information to disclose, and what safety, security, or operational measures to implement.
Under no circumstances shall Farm Stand Exchange be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of property, damage to real or personal property, theft, vandalism, personal injury, loss of income, or emotional distress, arising out of or related to your use of the platform or any exposure resulting from your listing.
This indemnification obligation shall apply regardless of whether the alleged liability arises in contract, tort (including negligence), strict liability, or otherwise, and shall survive termination of your use of the platform.
10. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law provisions.
